Investigation & Assessment

Legal Enforcement Services (LES)

At the Investigation stage, CJCH will

Assessment: This stage allows the Legal Enforcement Team to advise the client on the best options and enable the client to make an informed decision. The investigation is one of the most important stages of the process as it prepares each case for litigation.

Alternative dispute resolution (ADR) refers to ways of resolving disputes between entities that don’t involve going to court.

Common forms of ADR are:

Mediation, where an independent third party helps the disputing parties to come to a mutually accepted agreement.

Arbitration, where an independent third party considers the facts and takes a decision that’s binding on one or both parties.

A Cease and Desist letter (sometimes known as “letter before claim”) is a letter putting an infringing party on notice that court proceedings may be brought against them. They are sent to demand that the illicit activity ceases and it is resolved.

Is an order granted by court against a third party compelling them to disclose information enabling the identification of the wrongdoer. In the UK commonly known as the Norwich Pharmacal Order.

Through civil litigation, the copyright owner (plaintiff) seeks compensation and/or other legal remedies against the IP infringer (defendant). The case progresses through various stages, ultimately leading to a decision by a judge, or a settlement agreement between the parties that can be reached at any stage prior to the court resolution.

Copyright infringement is a crime. Following a criminal notice filed by an injured party or an investigation initiated ex officio by the authorities, charges are filed against the alleged infringer. When guilt is established, the criminal court will give a sentence imposing penalties for the infringements, adequate compensation and potential criminal records being imposed on individuals.

Through the exercise of the above-mentioned legal enforcement options, we have contributed to our client’s recovery of lost revenue in excess of 9M €, in more than 20 different jurisdictions.
